Terms Of Use

Any individual who accesses the State Grant Manager system and/or uses resources that access the system, whether by batch or online, must abide by the terms and conditions for accessing the system.

The user understands that personally identifiable information maintained and disseminated by either the user or OHE is subject to the privacy and confidentiality provisions of federal and state statutes, rules and regulations, including, but not limited to, the Family Education Rights and Privacy Act (20 U.S.C 1232g); related federal regulations (34 C.F.R. Part 99); the Minnesota Government Data Practices Act (MGDPA), Minnesota Statutes 13.01 et seq; and federal laws and regulations regarding students with disabilities (20 U.S.C. §1417 (c); 34 C.F.R. 300.32, 34 C.F.R. §§ 300.610-300.627). Protecting this information, once entrusted to the user, becomes the user’s responsibility.

The user understands that intentional submission of false or misleading information to the MN Office of Higher Education (OHE) is subject to fine and/or imprisonment under the MN False Claims Act, Minnesota Statutes 15C.

The user’s college will use reasonable efforts to store and process all data collected, created, used, maintained, or disclosed in such a way that unauthorized persons cannot retrieve the information by means of a computer, remote terminal, or any other means. The user’s college will use appropriate safeguards to prevent use or disclosure of private data on individuals by its employees, contractors, and agents, including but not limited to implementation of administrative, physical, and technical safeguards to reasonable and appropriately protect the privacy and integrity of individual-level data that it creates, receives, maintains or transmits under the State Grant Manager system. The user’s college will report any known data security or data privacy incidents to OHE as soon as they become known. Security incident means the unauthorized access, use, disclosure, modification, or destruction of information from the State Grant Manager system. Privacy incident means violation of the MGDPA or any other applicable state or federal data practices laws, including, but not limited to, improper and/or unauthorized use or disclosure of protected information and breach of security of information as defined by Minnesota Statutes, Section 13.055. This report must be made in writing and submitted to OHE after the security or privacy incident is discovered by the college.

The user’s system username and password shall be kept private and not released to any other individuals.

The user agrees to immediately notify OHE once the user no longer require access to the State Grant Manager system, such as leaving a position or experiencing a change in job responsibilities, so that the user’s access to the State Grant Manager system can be revoked.

If the user’s college does not participate in federal financial aid programs administered by the U.S. Department of Education, the user will not access a student’s information on the State Grant Manager system without a valid authorization form signed by the student. The user will only access the State Grant Manager system for official business reasons and will only use student data from the system that is required for the administration of the MN State Grant program.

The user will only access student data on the State Grant Manager system for students who have substantially established a relationship with the college at which the user is employed (e.g., applied for admission, included my college’s code on the Free Application for Federal Student Aid, etc.).

The user agrees to protect the State Grant Manager system from access by or disclosure to unauthorized individuals. This includes logging out of the State Grant Manager system when away from the user’s work station and storing the user’s username and password in a secure location.

The user agrees to not alter the underlying programming code used in the State Grant Manager system.

Registration by the financial aid director firms that the financial aid director has read and agrees to abide by these terms. After registration is approved by OHE, the financial aid director must provide a printed version of the terms and conditions to each staff member registered as a user on the system.
